Waiver Must Be Completed for Participant To Participate in the Drexel Clay Shoot at Hidden Brook Sporting Club
Participation Agreement and Release
STATE OF NORTH CAROLINA , COUNTY OF GASTON
Drexel Waiver
The undersigned participant (“Participant”) hereby represents, covenants, contracts, and agrees with The Drexel School Group, Inc., its successors, and/or assigns (collectively, “Drexel”) as follows:
(A) DANGEROUS ACTIVITIES. That the Participant fully acknowledges that all participation in the Drexel Clay Shoot at Hidden Brook Sporting Club (“Hidden Brook”), including, without limitation, shooting sports, firearms, archery, hiking, driving carts, and mountain biking, carry INHERENT DANGERS AND RISKS. Participant agrees to follow all instructions and directions of Hidden Brook club staff, guides, instructors, or any other posted rules of conduct;
(B) WAIVER AND INDEMNIFICATION FOR HARM TO PARTICIPANT. That the Participant covenants and agrees to indemnify and hold Drexel, its employees, Board of Directors, providers, volunteers, contractors and agents (collectively, “Drexel Group”) harmless and indemnify the Drexel Group from any and all liabilities, obligations, taxes, actions, losses, damages, claims, expenses (including attorney’s fees), disbursements, suits, injuries, or property damage of any kind and nature whatsoever suffered by the Participant while at Hidden Brook during or participating in the Drexel Clay Shoot, including without limitation which may have been caused or occasioned by the intentional, accidental or negligent acts or omissions (whether negligent, accidental or otherwise) of the Drexel Group or of, Hidden Brook Sporting Club, LLC, its employees, agents, successors or assigns (collectively, “Hidden Brook”), or any third parties, while at Hidden Brook during or participating in the Drexel Clay Shoot or during any of such activities;
(C) WAIVER AND INDEMNIFICATION FOR HARM TO OTHER. That the Participant covenants and agrees to hold indemnify and hold the Drexel Group harmless and indemnify the Drexel Group harmless from any and all liabilities, obligations, taxes, actions, losses, damages, claims, expenses (including reasonable attorney’s fees), disbursements, suits, injuries, or property damage of any kind and nature whatsoever suffered by any third party as a result of the acts, faults, negligence or omissions of the Participant, whether accidental, intentional, negligent or otherwise;
(D) CONDITION OF EQUIPMENT. That the Participant represents and warrants that any and all equipment or supplies (gun, shells, bows, bikes, etc.) brought onto Hidden Brook properties are in a safe and proper working order and all safety features are fully operable, and Participant is fully knowledgeable in the use of such equipment or supplies;
(E) EXPENSES AND ATTORNEYS’ FEES. That the Participant covenants and agrees that in addition to the matters identified herein, the Participant agrees to hold harmless and indemnify the Drexel Group for any and all expenses including reasonable attorneys’ fees, court costs, or other expenses associated with the defense of any action, claim or suit referenced herein;
(F) ASSUMPTION OF RISK. That the Participant, being fully aware of the inherent risks associated with participating in the Drexel Clay shoot including, without limitation, shooting sports, firearms, archery, hiking, driving carts, and mountain biking, hereby ASSUMES ALL RISKS associated therewith freely, knowingly, and voluntarily;
(G) That the Participant (or on behalf of a Minor, if applicable, as defined below) acknowledges their level of experience with firearms, shooting sports, mountain biking, archery or other participation activities at Hidden Brook for the Drexel Clay Shoot (whether none, limited, or extensive) and affirms they will only participate in activities within their skill level and in accordance with Hidden Brook’s instructions and safety guidelines;
(H) That the Participant is 18 years of age or older. If Participant is signing on behalf of a minor under 18 years of age (“Minor”), the Participant affirms they are the Minor’s parent or legal guardian, legally authorized to execute this Release (as defined below) on Minor’s behalf, and Participant hereby agrees to the terms and conditions herein on the Minor’s behalf; and
(I) The Participant (or on behalf of a Minor, if applicable) agrees that the representations, obligations and indemnities contained in this Participation Agreement and Release (“Release”) shall survive any revocation or other termination of this Release by Participant (or on behalf of a Minor, if applicable).
If you are a Participant and the parent/guardian of a Minor Participant, you will need to submit the form below once for yourself and once for your Minor Participant.
Drexel Volunteers (and parents of Minor Volunteers) must also submit the waiver below.
